Terms of Service

These terms cover your use of xocolatlchocolate.com and anything you buy from us. The site is run by Xocolatl, LLC (“Xocolatl Chocolate,” “we,” “us”). By using the site or placing an order, you agree to them.

1. Using our site

You must be of legal age where you live, or have a parent’s or guardian’s permission. Don’t use the site or our products for anything unlawful, to harass anyone, or to upload malicious code. We may refuse service, change prices or discontinue products at any time. If we list a product at the wrong price or with wrong details, we may cancel the order, even after confirming it, and refund you in full. Discount codes have no cash value, can’t be combined unless we say so, and may end at any time.

2. Pre-paid subscriptions

Pre-paid subscriptions are paid up front for 3, 6 or 12 months and ship once a month during that term. They end on their own: nothing renews and there’s nothing to cancel. To skip a month or change your shipping address, email orders@xocolatlchocolate.com. If you need to stop a subscription early, email us and we’ll work with you on the months that haven’t shipped. We may substitute products in a box. If a box arrives melted or damaged, our Refund Policy applies.

3. Shipping, melt and refunds

Risk of loss passes to you when we hand your order to the carrier (see our Shipping FAQ). Chocolate is perishable, so we don’t accept returns. If an order arrives melted or damaged, contact us within 7 days and we’ll make it right as described in our Refund Policy. In warm weather, please choose the faster shipping options we offer.

4. Allergens

Our products are made in a facility that handles nuts, dairy, gluten and other common allergens. We work to prevent cross-contact but can’t guarantee any product is free of traces. Please check ingredients before buying or eating. If ingredient information on our site differs from the package, follow the package label.

5. Our content and yours

Our logos, photos, text, packaging designs and recipes belong to Xocolatl, LLC. Please don’t reuse them without written permission. If you share reviews, photos or social posts about us, you let us use them for our business, royalty-free.

7. Text messages

If you sign up for texts from Xocolatl Chocolate, we’ll send marketing messages (like sales and new releases) and order updates to the number you give us. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help, or email orders@xocolatlchocolate.com. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

8. Liability

To the extent the law allows, we aren’t liable for indirect, incidental, punitive or consequential damages. Our total liability is limited to what you paid for the product in question. We’re not responsible for delays caused by events beyond our control, such as weather, natural disasters, pandemics, strikes, supply problems or government action.

9. Disputes

If you have a problem, email us first and give us 30 days to resolve it. If we can’t, these terms are governed by Georgia law, and disputes will be settled by binding arbitration under American Arbitration Association rules in Fulton County, Georgia. Disputes are handled individually, not as a class action, and both of us give up the right to a jury trial. Either of us may still use small claims court.

10. Changes

We may update these terms. We’ll announce material changes by email (if you have an account) or on the site. Continuing to use the site or buy from us means you accept the updated terms.

11. If part of these terms is invalid

If a court finds any part of these terms unenforceable, the rest still applies.
